The Legality of Skill Gaming

The concept of skill-based gaming has a long-established history in legal, social, and commercial circles. It has provided an opportunity for participants to compete based on their abilities, from classic board games to major sports tournaments. Nowadays, skill-based games are accessible on most major media sites such as AOL, MSN, and Yahoo, along with the rising electronic sports (eSports) industry that enables professional gamers to compete in popular video games for real money.

Playoff is a brand that promotes this trend, offering skill-based multiplayer tournaments on mobile devices and providing gamers with the chance to compete for actual prizes. Games powered by Playoff are distinguished as games of skill instead of games of chance, which sets them apart and makes them legally permissible in most of the United States.

Are skill-based tournaments considered gambling?
Cash-based tournaments in skill-based games are not regarded as gambling because the generally accepted definition of gambling includes three specific elements: (1) a prize, (2) paid-in consideration, and (3) an outcome determined by chance. Without all three of these factors, competitions that offer tangible rewards are not regarded as gambling. In the case of Playoff tournaments, the outcome is achieved through the player's skill and ability, not chance, making them legal in most U.S. states.

How are skill-based games different from chance-based games?
Skill-based games necessitate a physical or mental ability and a learned capacity to achieve a result. Such games commonly employ strategy, tactics, physical coordination, strength, technical expertise, or knowledge. On the other hand, chance-based games are games with an outcome mostly influenced by random chance or uncertainty. Common randomization devices include dice, playing cards, or numbered balls drawn from a container. Even though chance-based games may involve some skill, and skill-based games may involve some chance, most U.S. courts use either the predominance test or the material element test to evaluate the role of skill and chance in determining the game's outcome.
